1. About This Notice

Atlantic Institute for Resilience Inc. and AIR Resilience Inc. (collectively “AIR”, “we”, “us”, “our”) are committed to respecting and protecting the privacy of everyone who uses our websites, software, assessments, programs, and services (collectively, “Software Services”).

This Privacy Notice explains how we collect, use, disclose, and protect your personal information when you interact with AIR. By accessing or using our Software Services, you agree to the terms of this Notice. If you do not agree, you may choose not to access or use our Software Services.

We may update this Notice from time to time. The date at the top of this page reflects when it was last revised. We will make reasonable efforts to notify users of material changes.

2. Who We Are

AIR is a non-clinical resilience and mental fitness organization. We provide evidence-based resilience training, coaching, assessments, and workplace programming. We are not a healthcare provider and do not provide medical, psychological, or psychiatric treatment. Our services are developmental, not diagnostic.

AIR is based in Halifax, Nova Scotia, Canada and is subject to Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation.

3. What Personal Information We Collect

We collect personal information that is reasonably necessary to deliver our services. In general, we may collect:

  • Contact and account information: name, email address, and account credentials;
  • Demographic information: occupation, age range, gender identity, and level of education — collected to understand program effectiveness and for aggregate research purposes;
  • Self-reported resilience and wellness data: your responses to AIR assessments and programs, including resilience scores, burnout indicators, and organizational health measures. This data is self-reported and non-clinical;
  • Program participation and progress data: course completions, session attendance, and engagement metrics;
  • Website and technical data: IP address, browser type, device type, and pages visited — collected via cookies and analytics tools to improve our services;
  • Communications data: information you provide when contacting us through forms, live chat, email, or phone.

AIR does not intentionally collect Personal Health Information (PHI) such as medical records, diagnoses, or treatment plans. If you voluntarily share clinical or medical information with an AIR coach, that information will not be recorded and you will be referred to appropriate clinical services.

4. How We Use Your Information

  • Provide you with access to and a tailored experience within our Software Services;
  • Deliver resilience assessments, generate reports, and support coaching sessions;
  • Conduct aggregate research to validate and improve our programs and assessments;
  • Communicate with you about your account, our services, and relevant updates;
  • Monitor and analyse website and platform usage to improve our services;
  • Protect our rights, property, and the safety of our users;
  • Meet our legal and regulatory obligations.

We use aggregate, anonymized data — from which individual identity cannot reasonably be determined — for research, program evaluation, and marketing purposes. This may include sharing anonymized aggregate data with third parties. Anonymized data is not personal information and is not subject to the same restrictions as personal information.

5. How We Share Your Information

We do not sell, rent, or trade your personal information. We may share personal information in the following limited circumstances:

  • Service providers: We engage third-party vendors to help deliver our services (e.g., platform hosting, assessment delivery, communications). These vendors are contractually required to protect your information and may only use it to provide the contracted services.
  • Your organization: If you participate in an AIR program through your employer or organization, aggregate and anonymized program results may be shared with that organization for program administration and evaluation. Administrative information — such as session participation counts — may also be shared to allow your organization to manage and report on program delivery. Individual sensitive data (such as resilience assessment results, coaching reflections, or BrainGym responses) is never shared with your organization without your explicit consent.
  • Legal requirements: We may disclose personal information where required by law, court order, or regulatory authority.
  • Business transactions: In the event of a merger, acquisition, or sale of assets, personal information may be transferred to a successor organization subject to equivalent privacy protections.

6. Data Storage & Cross-Border Processing

AIR’s standard practice is to collect and store personal information within Canada. However, some of our third-party service providers may process or store data outside Canada, including in the United States, in accordance with applicable privacy legislation. Third-party service providers that may process data outside Canada include HubSpot (CRM and marketing) and Google Analytics (anonymized website analytics). Where personal information is transferred outside Canada, we ensure that appropriate contractual safeguards are in place.

Aggregate, anonymized research data may be stored and processed outside Canada.

7. Data Retention

We retain personal information only for as long as necessary to fulfil the purposes for which it was collected, or as required by law. Retention periods vary by Software Service. Our Data Collection & Usage Summary provides general retention information by product. You may contact us to request information about specific retention periods.

8. Security

We have implemented administrative, technical, and physical safeguards to protect your personal information from unauthorized access, use, or disclosure. These include access controls, encryption, and multi-factor authentication on systems holding personal data. No method of transmission over the internet is completely secure. While we work hard to protect your information, we cannot guarantee absolute security of data transmitted to us electronically.

9. Your Rights

Subject to applicable law, you have the right to:

  • Access the personal information AIR holds about you;
  • Request correction of inaccurate or incomplete information;
  • Withdraw consent to processing, where consent is the basis for processing (noting that withdrawal is not retroactive);
  • Request information about how your data is being used.

This Privacy Notice is governed by and interpreted in accordance with PIPEDA and applicable provincial privacy legislation, including the laws of Nova Scotia.
