Atlantic Institute for Resilience Inc. and AIR Resilience Inc. (herein referred to as “AIR”, “we”, “us”, and “our”) are committed to respecting and preserving the privacy of those who use access and use our websites, software, content, products, and services (collectively, the “Software Services”). This privacy notice (the “Privacy Notice”) governs the collection, use, and disclosure of personal information as individuals use the Software Services. By accessing or using a Software Service, you agree that you have read, understood, and agree to be bound by this Privacy Notice. If you do not accept the terms of this Privacy Notice, you may choose not access or use the Software Service.

As part of our regular review of all our policies and procedures, we may change this Privacy Notice from time to time without notice to you. AIR will make best effort to notify individual users of its respective Software Services for any changes to this Notice. The date on which this Privacy Notice was last updated will appear at the top of this page. Collection of Your Information

For the purposes of this Privacy Notice, personal information (“Personal Information”) means any information about an identifiable individual, as may be defined or limited under applicable privacy legislation. Personal information excludes anonymous or de-identified data that is not associated with a particular individual (herein referred to as “Non-identifiable Information”). Personal Information and Non-identifiable Information are collectively referred to in this Privacy Policy as “Information”.

We only collect Information that we believe is reasonably necessary for a legitimate purpose, as further described below. In order to access different Software Services, you may be required to register an Account, as set out in our Terms of Use, which requires you to submit an active email address. Throughout use of this website and our Software Services we collect data both Identifiable and Non-identifiable. We aim to keep you informed on the collection and usage of your data and a full list of information collected by Software Service can be viewed here. In addition to Information collected while you use one of our Software Services, we may also collect Information in other ways such as over the phone, via email and through live chat.

The choice to provide us with Personal Information is yours. In certain cases, your decision to withhold Information may limit the services that we can provide to you through the Software Services.

Use of your Information

We will only disclose your Information for purposes identified in this Privacy Notice, or if required by law.  The Information that we collect and store is primarily used for the following purposes:

  1. to provide you with access and tailored experience within ourSoftware Services;
  2. to provide you with information relating to our Software Services;
  3. to follow up on your comments and suggestions;
  4. to manage and develop our business systems and operations;
  5. to monitor and conduct an analysis of our website traffic and Software Services usage patterns;
  6. to post customer testimonials, comments or reviews;
  7. to protect our rights and property; or
  8. to lessen a serious threat to personal safety, health or security.

Access to private, sensitive and confidential information, including user’s Personal Information, is restricted to authorized employees with legitimate business reasons. We require all of our employees to abide by AIR’s privacy standards. Our employees understand the importance of keeping your information private. For this reason, our employees are required to agree to a confidentiality agreement that prohibits the disclosure of any user information to unauthorized parties. Employees are strictly prohibited from accessing or disclosing Personal Information without authorization.

We sometimes contract with outside organizations to perform specialized services such as hosting. Our suppliers may at times receive, process or handle some of your Information. Only the Information necessary to perform the services under the contract is given to the supplier. Under their contracts with us, our suppliers may use such Information only to carry out the contracted service and must not store or use the Information for any other purpose. Our contracts with suppliers require that they provide a level of protection for your Information that is comparable to our own.

We will not rent, sell, share, trade or otherwise distribute your Personal Information to third parties, except in accordance with this Privacy Policy and as required by law.

In some instances, such as a legal proceeding or court order, we may be required to disclose your Personal Information to authorities. Only the information specifically requested is disclosed and we take precautions to satisfy ourselves that the authorities that are making the disclosure request have legitimate grounds to do so.

We reserve the right to use the contact information of users for the purposes of communications regarding any aspect of a user’s account or corresponding services and products. Users will have the option to participate or opt out of optional communications (e.g. marketing, press, events) while regulatory mandatory communications (e.g. security updates) will go out to all active users.

AIR is not anticipating any changes in corporate status, however as we grow and develop that may change. You understand and agree that we may use your Personal Information and disclose your Personal Information to third parties in connection with the proposed or actual financing, insuring, sale, securitization, assignment or other disposal of all or part of our business or assets (including accounts) for the purposes of evaluating and/or performing the proposed transaction. These purposes may include, as examples, permitting such parties to determine whether to proceed or continue with the transaction, fulfilling any reporting or audit requirements to such parties, and/or disclosing Personal Information as part of concluding a sale or transfer of assets. Our successors and assigns may collect, use and disclose your Personal Information for substantially the same purposes as those set out in this Notice. In the event the transaction does not go through, we will require, by contract, the other party or parties to the transaction not to use or disclose your Personal Information in any manner whatsoever for any purpose, and to return or destroy such Personal Information. Personal Information that is collected online remains subject to applicable legislation and corporate policy.

Use of Non-Identifiable Information

We reserve the right to use aggregate and anonymized Information, for which it has been rendered impossible to identify the individual person which contributed the information, for any commercial purpose in our sole discretion.  Such commercial purpose may include, but is not limited to, sale to third parties to allow them to send targeted advertising messages.

Security

To ensure that your Personal Information is secure, we have put in place administrative, technical and physical controls to safeguard the Information we collect against unauthorized use, disclosure, or modification.

Nonetheless, transmission of information on the internet is not completely secure. Therefore, we cannot guarantee the security of data sent to us electronically on our website, by email or otherwise and transmission of such data is therefore entirely at your own risk. We will indicate when data for use in a Software Service is optional, and invite users to select what information they with to share by understanding the intended usage by specific Software Service here.

Accessing your Information and Correcting Errors

You have the right to access, verify, and amend all of your Personal Information.  Since we use your Personal Information to provide services to you and others, it is important that the information be accurate and up-to-date. If any of your Personal Information changes, is inaccurate, or is incomplete, please inform us so that we can make any necessary changes.

Consent

 Before your information is collected, you will be asked to review this Privacy Notice and consent to use of your personal information. You have the right to withdraw your consent from the processing of your personal information at any time. However, if you withdraw your consent, AIR Withdrawal of consent is not retroactive to past processing.

Governing Law

This privacy policy shall in all respects be governed by and interpreted, construed and enforced in accordance with PIPEDA, and the laws of Canada applicable therein.
